PRIVACY LAWS: any privacy legislation and regulation which refer to the processing of personal data and to data protection, including the EU REGULATION no. 2016/679 (“GDPR“) and Legislative Decree no. 196/2003 (“Privacy Code“).

Wildside S.r.l. (“Wildside”) is committed to protecting your personal information.

We hereby wish to inform you of: (i) type of personal data, collected and processed based on your consent, on a contract, on your request and/or legitimate interest of Wildside. This includes personal data that Wildside collects during any kind of interactions with you and/or with business partners from which Wildside receives your personal data, for the realization of an audiovisual work such as film, series, documentary, docufilm, factual, etc. (each work, or portion of work, “Production“) or, more generally, for commercial or business or administrative reasons; and (ii) on the method of processing based on which Wildside handles your personal data, advise on your rights and how the law protects you.

Type of data processed:

General Data
General Data: any information relating to natural person, identified or identifiable, even indirectly, including a personal identification number (“Data Subject“). Personal Data include, without limitation:
Professional Contacts	Name, surname, e-mail, telephone number, fiscal code, address, VAT, passport etc.;
Identyfing Data	any information relating to natural person, identified or identifiable, which determines the direct identification of the Data Subject: personal data, bank account, distinctive signs such as image, name stage, voice etc.
Professional Data	biographies, careers, data and information on previous and/or future contractual obligation undertaken by the Data Subject;
Bio Data	any information relating to a natural person, identified or identifiable, other than Particular Data, on any events occurred to the Data Subject, reputational data or any other information relating to the representation and/or documentation of situations and facts in the Production or necessary to assess the suitability of the Data Subject to participate in the Production.
Recording	audiovisual, sound and photographic recording that are the result of filming with a visible camera (performance/interviews) and/or “hidden camera” in studio or “outside” on the set or in public places or open to public or private locations (e.g. casting, filmed materials, daily, backstage, shot, photo, etc.)
Contractual Data	any information relating to a natural person, identified or identifiable, related to the performance of a contract or which refer to other contracts executed by Wildside or by Third Parties and/or by any other third-parties, including without limitation, the chain of rights.
CV’S	any information concerning a natural person, identified or identifiable, concerning applicants for job positions, provided voluntarily by the Data Subject in case of submission of requests for employment by sending resumes and/or received by Third Parties, recruiting companies and/or received through any job posting for recruitment/casting in sites or portals not directly managed by Wildside.
Navigating Data	any information relating to a natural person, identified or identifiable or any technical information (e.g. IP address, web pages and apps etc.) acquired through the IT systems and software procedures used to manage the Wildside website, during normal exercise.
Website’s Information	any information relating to a natural person, identified or identifiable provided voluntarily by the users to receive information from contacts of Wildside’s website or communicated during the consultation of Wildside’s web services accessible from the address www.wildside.it. Excluding Personal Data Details (as defined below).
SPECIAL DATA
Special Data: personal data relating to a Data Subject revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. Special data includes, without limitation:
Health Information	personal data which concerns physical or mental health of a Data Subject which reveal information relating to the past, current or future physical or mental health status of the data subject, relevant for the performance of the employment relationship, the ability of the Data Subject or possibility to perform contractual services, which may determine the need to prepare specific measures or use special products (diseases, intolerances, allergies, specific nutritional needs or disabilities, etc.), relevant for the performance of his/her services, etc.
Sensitive Data	any information relating to the Data Subject on any events occurred to the Data Subject, able to reveal the racial or ethnic origin, political opinions, religious and philosophical beliefs, union membership, life or sexual orientation, health status.
Judicial Data	Any information relating to the Data Subject able to reveal the existence of judicial measure
NON-PERSONAL DATA
Non-Personal Data: any information which does not identify any natural person.
CATEGORIES OF DATA
Data Relating to the Production	Professional Data, Identifying Data, Professional Data, Biographical Data, Recordings, Contractual Data, and Data concerning health collected during the Production, provided by the Data Subject to the development and production team (agents, talent scouts, family members, friends, employers, sound engineers, stage photographers, set organizers and administrators, drivers, catering, press offices, laboratories, make-up artists etc.) or other people working at Wildside Productions and/or in rendering all the services related to the execution of a contract for example (“Production Contract“) with Wildside and, more generally, all the services rendered by a participant to a Production during the development, production, promotion and distribution phases. Recordings established during the production process and processed by virtue of a Production Contract.
Data Relating to Application Activities	Data Professional Contact, Identifying Data, Professional Data, Biographical Data, Recordings and Data concerning health communicated in order to participate in a casting, or during a casting, of Wildside and/or to organizers and/or to people involved in casting, used to determine the evaluation of the relevant application and to fulfill a legal obligation related to a casting. Recordings during the casting.
Negotation Data	Data Professional Contact, Identifying Data, Professional Data, Biographical Data, Recordings and Data concerning health, collected and processed by Wildside during the negotiation, conclusion or execution of the contract with the Data Subject and/or by virtue of the professional relationships between Wildside, the Data Subject and/or Third Parties and/or in the framework of any commercial, administrative and business activities of Wildside (“Negotiation”);
Employment Data	Personal Data are acquired directly by Data Subject or by third parties during the selection or the employment relationship, through the CV’s and/or through the form signed during the relevant application.

2. PURPOSE OF PROCESSING AND LEGAL BASIS.

Legal Basis Processing necessary for the execution of a contract or for the adoption and execution of pre-contractual steps or to fulfill obligations and exercise the rights of Wildside or Third Parties’s or the Data Subject’s with respect to labor law and safety on the workplace pursuant to art.6, para.1, lett. b) and/or c) GDPR and/or to pursue a legitimate interest of Wildside and/or the Third Parties’ s pursuant to art. 6, para.1, lett. f) GDPR.
		Production Data will be processed until required to exercise or protect the rights of the data controller and / or Third Parties’s as stated in the Production Contract and for the subsequent period required by law or justified by legitimate interest. They will then be anonymised for statistical purposes or destroyed, unless otherwise stated by regulator, police and judiciary or justified by the legitimate interest and/or to exercise or protect the rights of the data controller and/or Third Parties’S.
	• For the performance of the Agreement useful: – to comply with the legal, social security, tax and administrative obligations of the Data Controller and generally to fulfill any legal obligations related to the organization and realization of the Production; – to perform any administrative/accounting obligation (also to supervise the budget of the Production and/or administrative and/or financial and/or or of companies belonging to the group), including through IT tools; – any specific requirement necessary for the Production (including the organization of production, set, the preparation of the agenda and the lists necessary in order to organize the Production), as well as any requirement connected to the distribution and/or the promotion; – litigation and/or investigations aimed to verify compliance with internal policies (including corporate security). • For the same purposes, the Production Data may be communicated in whole or in part to any other company controlled or subsidiary to the Data Controller and/or Third Parties, whose Data Controller will make negotiations or conclude agreements related to the financing, development, realization production, marketing, promotion of the Production.	Processing necessary for the execution of a contract of which the Interested party is party to, or to fulfill obligations and exercise the rights of the Data Controller, the Third Partie’s or the Data Subject’s in with respect to labor law and social security and protection pursuant to ‘art.6, para.1, let. b) and/or) GDPR and/or to pursue a legitimate interest of the Data Controller or third parties pursuant to art.6, para.1, lett. f) GDPR.
		The Production Data will be processed for 24 months from the end of the shooting period and/or from the end of the Production Contract and for the subsequent period required by law or justified by the legitimate interest. They will then be anonymized for statistical purposes or destroyed, unless otherwise provided by the regulator, police and/or judiciary or justified by the legitimate interest and/or to exercise or protect the rights of the Data Controller and/or Third Parties.
Application Data	• For the selection of participant in a Production, also for the purposes of any participation in other casting; • To fulfill any legal obligations connected to the organization and implementation of the Casting and any other subsequent casting and/or to fulfill obligations and exercise rights of Wildside and/or Third Parties’s and/or Data Subject’s with repect to labor law and the security and social protection or legitimate interest of Wildside and/or the Third Parties’s; • For the same purposes, the Casting Data may be communicated in whole or in part to any other company controlled or subsidiary to the Data Controller and or Third Parties’s, with whom the Data Subject will make negotiations or conclude agreements related to the financing, development, realization, production, marketing, promotion of the Production.	legal basis Processing necessary for the execution of pre-contractual steps or to fulfill obligations and exercise the rights of Wildside or of Third Partie’s or of the Data Subject’s with respect to labor law and social security and protection of Article 6, para. 1, lett. b) and/or c) GDPR and/or to pursue a legitimate interest of Wildside and/or the Third Parties pursuant to art. 6, para.1, lett. f) GDPR.

Subsequently, they will be anonymized for statistical purposes or destroyed, unless otherwise arranged by Controller, police and the judiciary
	• For the realization of the Production, including derivative works, promotional materials such as “Making of”, “Backstage”, “Special” and/or “Highlight”, “Clip” and / or “Behind the scene” or other audiovisual material relating to a casting and/or production (unless otherwise agreed in writing with Wildside); • For the exploitation of the Production (including the exercise of the rights of the Data Controller and/or Third parties’s), as well as for the storage of production and /or production information in archives and public and private databases or with the Data Controller and/ or laboratories, as well as in order to obtain financing, subsidies, contributions and/or public or private benefits; • To examine sources/documents/data; • For the same purposes, the Application Data may be communicated in whole or in part to any other company controlled or subsidiary of the Data Controller and/or to Third Parties, with whom the Data Controller will make negotiations or conclude agreements related to the financing, development, realization, production, marketing, promotion of the Production.	Legal Basis Processing necessary for the execution of a contract of which the Interested party is a party to, to fulfill obligations and exercise the rights of Wildside or of Third Parties’s or of the Data Subject’s with respect to labor law and social security and protection pursuant to art. 6, lett. b) and/or c) GDPR and/or to pursue a legitimate interest of Wildside or Third Parties’s pursuant to art. 6, para.1, lett. f) GDPR.
		Duration The Application Data will be processed until required to exercise or protect the rights of the Data Controller and/or Third Parties and for the subsequent period required by law or justified by legitimate interest. Subsequently, they will then be anonymized for statistical purposes or destroyed, unless otherwise provided by the supervisory authorities, law enforcement agencies or justified by the legitimate interest and/or to exercise or protect the rights of the Data Controller and/or third Parties’s.
Professional Contact Data – Identification Data – Professional Data	• For the retention in databases containing application/ information related to contributors and/or participants in casting activities or Wildside productions for any exploitation related to future productions; • For the development, financing searches and for the presentation of new projects to Third Parties (such as potential financers, distributors, co-producers, platforms, etc.); • For the same purposes, the Professional Contact Data, Identification Data, Professional Data may be communicated in whole or in part to any other company controlled or subsidiary to the Data Controller and/or Third Parties, with whom the Data Controller will make negotiations or execute agreements related to the financing, development, realization, production, marketing, promotion of the Production and/or Negotiations.	Legal Basis Processing necessary to pursue a legitimate interest of the Data Controller and/or Third Parties pursuant to art.6, para.1, lett. f) GDPR.
		The application Data will be processed until required to exercise or protect the rights of the data controller and/ or Third Parties’ and for the subsequent period required by law or justified by legitimate interest. They will then be anonymized for statistical purposes or destroyed, unless otherwise provided by the supervisory authorities, law enforcement agencies or justified by the legitimate interest and/or to exercise or protect the rights of the Data Controller and/or Third Parties’S.
General Data and Special Data	• For purposes related to the realization and/or exploitation of the Production that do not require the consent of the Data Subject, however, that such processing will be in compliance with the rights, fundamental freedoms and dignity of the Data Subjects to whom the personal data (including the Data and Special Data) refer to;	Legal Basis Processing aimed to the publication or even occasional diffusion of articles, essays and other manifestations of thought also in artistic and literary academic expression, which does not require the consent of the Data Subject pursuant to art. 136 and ss. of the Privacy Code and art. 85 GDPR and/or for the implementation and execution of pre-contractual measures and/or to fulfill obligations and exercise rights of Wildside and/or Third Parties pursuant to Article 6, para.1, letter b) and c) GDPR

Data Collected During The Negotiation	• To fulfill the obligations / perform the services referred to during the Negotiation (including any requirement connected to the production and/or organization of the set, including the preparation of the agenda and the preparation of any lists necessary for the organization of production activities) as well as for the performance of any relationship with Third Parties, in relation to the performance by the Data Subject of the activities referred to during the Negotiation with the Data Controller and/ or the assignment to him on behalf of the Data Controller; • To comply with administrative/accounting purposes, also through IT tools: payment of fees, and/or verification aimed to verify the compliance with internal policies; • To fulfil any legal obligations (including obligations relating to safety on the workplace, accounting, taxes, social security); • To fulfil with internal verification (audit, internal -group reporting) and external activities (security) management of any litigation; • To exploit the Production (including the exercise of the rights of the Data Controller and/or third parties), as well as for the storage of the Production and/or of any production-related information in archives and/or public and private databases or with the Data Controller and/or laboratories, as well as to obtain financing, subsidies, contributions and/or public or private benefits; • For the same purposes, the Data collected during the Negotiation may be disclosed in whole or in part to any other company controlled or subsidiary to the Data Controller and/or Third Parties, with whom the Data Controller will negotiate or execute agreements related to the financing, development, implementation, production, marketing, promotion of the Production and/or in any case in the framework of Wildside’s commercial, administrative and business activities. 		Duration The Data collected during the Negotiation will be processed for the duration of the existing Negotiation with the Data Subjects and, following such term, until it will be required to exercise or protect the rights (including the rights connected to the Production) of the Data Controller and/or Third Parties and for the subsequent period required by law or justified by legitimate interest. Afterwards, they will be anonymized for statistical purposes or destroyed, unless otherwise provided by the supervisory authorities, law enforcement agencies and judiciary or justified by the legitimate interest and/or to exercise or protect the rights of the Data Controller and/or Third Parties.
Website Information	• For the defense by Wildside in court, by abuses deriving from an unlawful use of the website or related services by the user; • For statistical purposes in an anonymous form (to determine the number of accesses, etc.); • For aggregate promotional and commercial activities; • For the management of general requests.	Legal Basis Processing necessary for the execution of a contract of which the Data Subject is a party to or for the execution of pre-contractual measures implemented upon request and or to fulfill a legal obligation which Wildside has to comply to subject pursuant to art.6, para.1, lett. b e/o c) GDPR.

Health Information	• To keep, check and update records relating to employee presence; • To assess eligibility to carry out the applicable role • To enable Wildside to fulfill its obligations under the law. • For the same purposes, Health Information may be communicated in whole or in part to any other company controlled or subsidiary to the Data Controller and/or Third Parties, with whom the Data Controller will enter into negotiation or conclude agreements related to the financing, development, implementation, production, marketing, promotion of a production and/or in any case in the framework of Wildside’s commercial, administrative and business activities.	Legal Basis Processing necessary for the execution of a contract of which the Data Subject is a party or to fulfill obligations and exercise the rights of Wildside and/or the Third Parties and/or the Data Subject with respect to labor law and safety and social security according to art.6, para.1, lett. b) and/or c) of GDPR.

CV’S	• For perform activities strictly related to evaluation, recruitment or selection of personnel, with objectives of collaboration, fixed-term or permanent employment, internship; • To evaluate any CV’s received, consistent with any internal needs; • To evaluate the potential applications within the company or that could be presented in the near future; • For the same purposes, the Curricula Data may be communicated in whole or in part to any other company controlled or connected to the Data Controller and/or Third Parties, with which the Data Controller will negotiate or conclude agreements related to financing, development, implementation, production, marketing, promotion of a Production and/or in any case in the context of Wildside’s commercial, administrative and business activities.	Legal Basis Processing of CV’s is necessary for the implementation and execution of pre-contractual measures or to fulfill obligations and exercise the rights of Wildside and/or of the Third Parties and/ or the Data Subject with respect to labor law, safety and social security according to art.6, para.1, lett. b) and/or c) of GDPR or to pursue a legitimate interest of Wildside and/or Third Parties’s pursuant to art.6, para.1, lett. f) GDPR.

Employment Data	• To perform employment relationship, to fulfill legal obligation applicable to the Employer, workplace hygiene, safety on the workplace, accounting, tax, welfare, social security contributions (eg, equal opportunities, holidays, working hours/absences, and in general to fulfill any legal obligations connected to the employment relationship). • To perform any administrative/accounting activities, including through IT tools: payment of salaries, compensation and incentive plans, disputes and/or assessments aimed to check the compliance with internal policies; • For the performance of relationship with Third Parties, in relation to the performance by the Data Subject of the activities referred to in the contract and/ or the role of the Data Subject on behalf of the Data Controller; • For company security (access control, also via video monitoring systems); • For the same purposes, the Employment Data may be communicated in whole or in part to any other subsidiary or affiliated company of the Data Controller and/or Third Parties’s, with which the Data Controller will negotiate or conclude agreements related to financing, development, creation, production, marketing, promotion of an audiovisual product and/ or in any case in the Wildside’s commercial, administrative and business activities.	Legal Basis Processing necessary for the execution of a contract of which the Data Subject is a party, to fulfill obligations and exercise the rights of the Data Controller’s, of the Third Parties’s or of the Data Subject’s with respect to labor law and social security and protection pursuant to art.6, para.1, lett.b) and/or) GDPR and/or to pursue a legitimate interest of the Data Controller or Third Parties’s pursuant to art.6, para.1, lett. f) GDPR.
		Duration The Employment Data will be processed for the duration of the employment relationship and, after termination of employment, until required to exercise or protect the rights (including the rights referred to the audiovisual products) of the Data Controller and/or Third Parties’s as provided in the contract and for the subsequent period required by law or justified by legitimate interest. Subsequently, they will be anonymized for statistical purposes or destroyed, unless otherwise provided by the supervisory authorities, law enforcement agencies and judiciary or justified by the legitimate interest and or to exercise or protect the rights of the Data Controller and/or Third Parties.

SPECIAL CATEGORIES OF PERSONAL DATA

Children under the age of 18 shall not send or post any Personal Data or Special Data without written consent from their parents or guardians.

Parents or guardians may revise or change personal data of the children transmitted to Wildside or subsequently refuse the collection of such information by Wildside by sending an e-mail to privacy@wildside.it.

Wildside does not intend to sell, license or market any of such information to Third Parties.

SOURCE OF PERSONAL DATA PROCESSED

Ordinary Personal Data and Special Data processed are those that Wildside collects when it deals with the Data Subject for whether reason and with other commercial partners (including Third Parties) or third parties from whom it receives the data due to the negotiation, conclusion, execution of pre-contractual actions and/or a contract connected to a Production and/or administrative, retributive, contributive, fiscal, legal and/ or general conditions for commercial and business purposes.

THIRD PARTIES RECIPIENTS

In connection with the performance of contractual or legal obligations or to pursue the purposes described above and legitimate interests, we may share your Personal or Special Data with “Third Parties” as: (i) subjects to whom Wildside entrusts certain activities (or part of them) connected or instrumental to the performance of the aforementioned processing activities and/or maintains relationship related to its activity. In this case, said subjects will operate as autonomous Data Controllers, joint Controllers or will be entrusted as Data Processor. These subjects are included in the following categories: Development and production teams: agents, talent scouts, family members, friends, employers, sound engineers, stage photographers, set organizers and administrators, drivers, catering, press offices, laboratories, make-up artists; Wildside partners and suppliers: individuals, legal or natural persons, such as administrative, accounting, tax, banking, insurance, recruiting companies, consultants, Wildside business partners, co-producers, lenders, associated producers, licensees, distributors, catering, logistics, travel agencies, IT services companies, sponsors, advertisers (ii) Authorities: supervisory bodies, judicial authorities, collecting societies, trade unions, trade associations, public bodies and administrations including ministries, social securities and welfare organizations, law enforcement, in compliance to the regulation on safety and work-hygiene (Legislative Decree 81/2008). Unless you have given your consent, we will not provide information to the Third Parties regarding the Data Subject for direct marketing purposes. The updated list and more information on the methods of processing Personal or Special Data by Third Parties and on the exercise of rights by the Data Subject can be found at Wildside.

6.TRANSFER OF PERSONAL DATA ABROAD

The Personal and Special Data for the same purposes mentioned above may be transferred outside the European Economic Area in compliance with an adequacy decision (such as the EU-US agreement called Privacy Shield), or in any case implementing the action provided for in Article 46 of the GDPR, and in any case only to comply with a legal obligation, by virtue of an existing contract with the Data Subject and/or where justified by a legitimate interest of Wildside or Third Parties’s.

NATURE OF PROCESSING

The provision of the Production Data and/or Application Data and/or Negotiation Data for the purposes described above is necessary to participate in the Productions and/or to perform the services or supply the goods subject of the commercial transactions that have been made with Wildside. Any refusal to provide the Production Data, Application Data and Negotiation Data by the Data Subject will prevent the possibility of participating in the casting and being chosen, or promptly contacted, for the purposes of any participation in the Production and/or participate in the Productions and/or derived productions from or connected to them and/or receive from Wildside/ make by the Data Subjects or third parties the goods and services subject to commercial transactions with Wildside. The user is free to provide other personal data to obtain what has been requested.

RIGHTS OF THE DATA SUBJECT

Pursuant to art. 15 and ss. of the GDPR, the Data Subject have the right to obtain from Wildside the confirmation that their personal data are being processed. The Data Subject has the right to ask Wildside to: (i) access personal data; (ii) rectify personal data (iii) erase personal data; (iv) restrict the processing of personal data (v) right to data portability (vi) opposition to the processing of personal data.

The Data Subject has the right to lodge a complaint with a supervisory authority; the contact details of the Italian Authority (Data Protection Authority) can be found on the website www.garanteprivacy.it.

Furthermore, Wildside informs that the Data Subject has the right to obtain the following information: (i) the purpose and existence of the processing (ii) categories of personal data being processed (iii) the recipients or categories of recipients to whom the personal data are been or will be disclosed, in particular if recipients of third countries or international organizations (iv) whenever possible, the retention or, if not possible, the criteria used to determine this period (v) in the event personal data are not collected directly from the Data Subject, all information available on their cause.

If personal data are transferred to a third country or to an international organization, the Data Subject has the right to be informed of the existence of adequate guarantees pursuant to art. 46 relating to the transfer. Wildside provides a copy of the personal data being processed. In case of further copies requested by the Data Subject, Wildside may charge a reasonable fee contribution based on administrative costs.
